By becoming a member or using our Service, you accept and agree to these Terms and Conditions (hereinafter: "Terms"). Therefore, it is important that you carefully read through these Terms. If you do not consent to these Terms, you should not use our Service.
About Foodbok
Foodbok is a service (hereinafter: "Service") developed and provided by Pavel Rydvanskiy. The service is available online at foodbok.com and in the iOS at Apple App Store as "Foodbok" mobile application (hereinafter: "App" or "Product"). It allows users to track their food consumption, activity, weight and contribute information to help people lead healthy lifestyle and achieve their weight goals. The mission of the Service is to simplify routine and to inspire people to a healthy lifestyle.
Using Service
To use Service, you must follow some simple rules. Do not misuse the Services, so that either It or anyone else is harmed in any way. You may only use the Services as permitted by law and these Terms.

By using our Services, you agree that:
  • Service is only available for your private use and is not intended for commercial use.
  • All of the personal data provided by you is accurate and up to date.
  • You are solely responsible for all activities on your account and all the content that is uploaded and/or created under your Foodbok account.
  • Service reserves the right to remove your user account with all your data and to terminate your membership at any time at its sole discretion,
  • Your membership, including your email and password, with Foodbok, is personal and may not be transferred or used by someone else. You are responsible for storing your login details in a safe manner. Service is not in any way responsible for any loss or damage caused by unauthorized access to your account or use of your login details. If you learn of or suspect any unauthorized use of your account, you must immediately inform us. Contact details are available at the bottom of this document.
  • Service is not intended for use by people under the age of 13. To use Service, you must be at least 13 years old.
  • Violation of any of these Terms will lead to a direct termination of your user account and subscription. If you violate these terms, you will not get a refund.
  • You are not allowed to engage in any commercial activities, advertise and/or provide hints (such as links) on where commercial activities are present through our Services.
  • You must not engage in any unlawful activities on the Service, such as (but not limited to) contributing with information which in any way contains or involves incitement to racial hatred, defamation, harassment, child pornography or pornography.
  • You are not allowed to contribute to any propaganda, religious and/or political views.
  • If you have any criticism or feedback regarding of our Service, contact us firstly. It will help to improve our Service.
  • You may not transmit, and/or distribute files that may damage Service or others' computers or property (such as viruses and trojan horses).
  • You may not share others' personal information, without their approval.
  • You are responsible for your own health. Information made available through the Service shall solely be used for recreational and educational purposes. This Service is not a medical organization and will not provide you with any medical advice or diagnosis. Service is not responsible for any personal injury or any other damages that may have been the result, direct or indirect, of any use or misuse.
Your account
You can cancel your membership and/or delete your account within all your personal data at any time. Please note, that uninstalling the mobile application or deleting your account will not automatically stop your subscription — you must cancel the subscription by yourself in your Apple App Store account. To find out how to cancel the subscription and/or your account, please follow the instructions in the App. Special terms and conditions apply to Foodbok PRO.
Health and Nutritional Information
You are responsible for your own health. Service is not a medical organization and it will not provide you with any medical advice or diagnosis. Information made available through the Service shall solely be used for recreational and educational purposes. Always consult with your doctor before starting a diet or fitness program or if you feel any pain or discomfort. Service cannot guarantee any health, weight and/or fitness results or improvements. Service is only intended for healthy adults, and please do not use Service if you suffer from, or might suffer from, any medical condition that may be impaired by diet or exercise. Nutritional information found in our database has not been verified, investigated or reviewed by us. Service cannot guarantee that the nutritional information provided in it's database is accurate, reliant or complete. Service is not responsible for any personal injury or any other damages that may have been the result, direct or indirect, of any use or misuse.
Foodbok PRO
This section only applies when you purchase and/or subscribe to Foodbok PRO. By paying the subscription fee, you get full access to all Service functionality during the time your subscription is valid, subject to these Terms. All subscriptions with Service are paid in advance.

You may at any time terminate your membership, in which case your membership will still be valid for the subscription time you have already paid for. You can only cancel your subscription through your Apple App Store account. Service reserves the right to change the subscription fees from time to time.

Intellectual property
You use the Service at your own risk. The Service is provided "AS IS," without any warranties, and warrant that the Service will be uninterrupted or error-free. We do not assume any responsibility for errors or omissions in the information or software or other documents, which is referenced by or linked to. References or links to third parties' websites are provided "AS IS", without warranty of any kind, either express or implied.

In no event shall we be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence. To the maximum extent permitted under applicable law, Service's aggregated liability for any direct damages shall be limited to membership fees paid by the user.
Changes to this Terms
From time to time, it may become necessary to make changes to this Terms. Therefore, we reserve the right to update and/or modify this Terms at any time by posting the new Terms on this page. Please review this Terms frequently, and especially before you register an account with us. The date of the last modification is listed at the top of this Terms.

Encryption
All the incoming and outgoing data traffic when communicating with the App or with third parties is encrypted via TLS. The code "https://" in the address bar and the lock icon show you that the connection for using our website is encrypted. TLS encryption means that third parties cannot read the data transmitted.
Information collection and Use
PERSONAL DATA
"Personal data" in terms of the GDPR means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

The Service only processes the personal data concerning you (e.g. email address, nutritional information in the App) in accordance with the provisions of applicable data protection law as amended. The following provisions inform you about the nature, scope and purposes of collecting, processing and using personal data. This Data Privacy Policy applies only to the aforementioned Product. If a link leads to you another website, please check the information there for the respective treatment of the personal data concerning you.
DATA COLLECTION WHEN USING FOODBOK APP
When you register in Foodbok App, Service collects personal data from you such as: your email address, password, height, weight, date of birth and gender.

When you continue using the Foodbok App you regularly upload personal data onto your account such as, depending on your use of the App; your calorie intake, weight loss goal/weight gain goal, activity/diet routines, your body measurements and BMI.

In an ongoing effort to improve App, additional personal data may be collected from you. In such cases, we will notify you when the personal data collection takes place.
MANDATORY INFORMATION
In order to be able to use the App, the user must provide an email address and a password (mandatory information). These data serve to identify the user and to enable communication between the Service and the user. The email address and all the user's other data are not visible to other users.
DATA PROVIDED BY THE USER
FoodBoK App further records data provided by the user that can be entered when using the App. This refers to a user profile that consists of the following physical data:
  • gender
  • date of birth
  • height
  • desired result (lose weight, etc.)
  • weight

The physical data are recorded and are used exclusively to calculate your personal calorie intake. In order to be able to use the features of the App, physical data need to be provided. It is particularly necessary to provide the weight, gender, date of birth and height so that Service can calculate the user's personal calorie intake target. These data are not visible to third parties.

Furthermore, the following data are collected and stored when the user account is set up:
  • First name or nickname (optional)
  • Email address
  • Password

As you continue to use the Service, you will regularly provide further personal data. It follows from the nature of the Services. For example, Service will process your weight data and calorie intake to enable the monitoring and presentation of your personal goals (whether it be weight loss or weight gain). This processing is a prerequisite being able to offer the Services to you.

DATA AUTOMATICALLY RECORDED BY SERVICE
The following data is recorded once when the user registers in Service:
  • Date of registration
  • Operating system of the device used
  • Country and language (using the locale: The locale is a set of parameters that contains the user's regional settings, including in particular the language of the user interface, the country and settings regarding the character classification, keyboard layout, number, currency, date and time formats.

This data records for the purpose of improving and personalizing Service content.

DATA RECORDED DURING THE USE OF THE APP
When the App is used, Service further records:
  • the operating system and version of the device used,
  • the version of the App in use,
  • the current time zone and language.

LOG DATA
In a case of an error App collects data and information on your phone called Log Data. This Log Data may include information such as your device Internet Protocol ("IP") address, device name, operating system version, the configuration of the app when utilizing Service, the time and date of your use of the Service, and other statistics. This data records for the purpose of improving service and helping you with problems.
DATA EXCHANGE WITH THIRD PARTIES
Service further records and stores data that are made available by third party providers and transmits the corresponding data to such third party providers. This refers to the following providers and data:

  • various fitness, nutritional and physical data

This data records for the purpose of improving and personalizing service content.
CONTRACTUAL RELATIONSHIP
If a contractual relationship is to be established, designed or amended between the user and Service, Service stores the user's personal data to the extent that this is needed for the performance of the contract. By means of In-app purchasing, the user has the option to subscribe to the Foodbok PRO. If you decide to subscribe to the Foodbok PRO, the order button will lead you directly to either the Apple AppStore.

In this context, Service will transmit the starting date and the end date and, if applicable, the termination date of the subscription and the reason for the termination (for instance, withdrawal). The data for processing the payment are collected directly by the app stores.

Customer contact and support
Service uses Freshdesk, a customer service platform operated by Freshworks Inc., 2950 S.Delaware Street, Suite 201, San Mateo, CA 94403 to handle customer requests. In this context, the FoodBoK App records the e-mail and user identifier in order to comply with information requirements.

These personal data provided by you when you make a customer request are used only for the purpose of replying to your question or for contacting you and for the associated technical administration work. Such data is not forwarded to third parties.

Web analysis, remarketing and retargeting tools
We use various tools or plugins to conduct web analysis, remarketing, and retargeting in order to optimise our online offering and to be able to compile more relevant offers for you.

These services use cookies, forward the IP address and/or record and analyse various types of data, including the number of website visitors, duration of the visit, average page loading time and origin of the visitors.

GOOGLE FIREBASE ANALYTICS
We use Firebase Analytics for the App. Firebase Analytics is a service offered by Google Inc.

The Firebase Analytics service helps to determine the interactions of App users by recording, for instance, the first time the App is opened, deinstallations, updates, system crashes and how often the App is used. The service also records and analyses certain user interests. The information processed via Google Firebase may also be used together with other Google services, such as Google Analytics and the Google marketing services. The tool uses identifiers like the Android Advertising ID or the Advertising Identifier for iOS and cookie-like technologies to identify the users' mobile devices.

GOOGLE FIREBASE CRASHLYTICS
App further uses the Crashlytics analysis program offered by Google Inc. Crashlytics provides us with information on unforeseen system crashes and other malfunctions, thus serving our legitimate interest to constantly improve the App and eliminate faults. When a fault occurs, the analysis program records and transmits information on the device in use, the operating system, the version and functionality of the App, time of the crash and the anonymized IP address of the requesting device. Transfer of data
Personal data collected from you may be shared with third-party providers of Service; such as server hosting providers, data storage providers, companies carrying out system and sales performance monitoring, customer support systems- and payment service providers. These service providers will be considered processors of your personal data.

At times, some of your personal data by may be transferred and processed to processors, as described above, that are established in the United States or other countries (some of which will be outside the EEA). We will always apply safeguards to protect your personal data from unauthorized disclosure.

In no event does we transfer personal data to third parties with the right for such parties to use the data other than on behalf of Service, except as provided by law.

Erasure of your data
Service stores personal data concerning users as long as the App is used. When the user account is deleted, the email address, first name, profile image and links to third party providers is erased irrevocably.

RIGHT OF ACCESS
You have the right to request, free of charge at any time, information regarding the personal data concerning you that is stored by Service, the origin and recipients of such data, the purpose of data processing, the planned duration of data storage and a copy of the personal data that are being processed.
RIGHT TO RECTIFICATION
You further have the right to obtain without undue delay the rectification of inaccurate personal data and to have incomplete personal data completed.
RIGHT TO ERASURE
You have the right to obtain erasure of personal data concerning you without undue delay if the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed or if you withdraw your consent to lawful processing and there are no other legal grounds for the processing. If you object to data processing and there are no overriding legitimate grounds for the processing, your data will also be erased. Finally, your data will be erased if processing is unlawful for any other statutory reasons.
Children
This Service does not address anyone under the age of 13. Further, we encourage parents and legal guardians to monitor their children's Internet use and to help us in enforcing our Privacy Policy by instructing their children to never provide any personal data without their permission.
